DOJ Quietly Surrenders in Post Office Gun Ban Fight

After years of defending a ban on carry in Post Offices and on postal ground, the Justice Department suddenly abandoned the fight.

The U.S. Justice Department dismissed its challenge to a ban on possessing and carrying guns in U.S. Post Offices this week.

A voluntarily dismissal in FPC v. Blanche was filed by the DOJ Thursday in the U.S. Fifth Circuit in New Orleans.

FPC v. Blanche was originally filed in June 2024 by the Firearms Policy Coalition, Second Amendment Foundation, and citizens Gavin Pate and George Mandry. It alleged that a ban on firearms on postal property and in Post Offices was unconstitutional.

In September 2025, the Northern District Court of Texas agreed, stating that a carry ban violated the Second Amendment, and a nationwide injunction took effect.

Up until recently, the Justice Department staunchly supported the ban on guns in U.S. Post Offices; but that seemingly changed this week. The federal government quietly submitted the motion to voluntarily dismiss, laying a win at gun owners’ feet.

“This is huge news for SAF members,” SAF Senior Director of Legal Operations Bill Sack, said in a statement.

“We now have finality and clarity that the hard-fought injunction we secured on behalf of our members, striking down the post office carry ban is the permanent outcome of the case. The government appears to now agree, especially in light of the recent Wolford decision, that the ban on the lawful carry of firearms in post offices fails constitutional muster.”

At the moment, this victory only covers FPC and SAF members; but that could change in the future with additional rulings or an overall repeal of the post office gun ban.
